Sheldon Silver — Putting The Interest of Trial Lawyers Ahead of Us

Is there any better poster boy for Albany reform than Assembly Speaker Sheldon Silver?  According to the New York Post, Shelly’s at it again:

SHELLY RIPPED FOR

50G LAW LOAN

ALBANY - A political rival yesterday blasted closed-mouthed Assembly Speaker Sheldon Silver for lending $50,000 to a small company that funds personal-injury lawsuits and could be hurt by efforts to limit lucrative awards to trial lawyers - including those at Silver’s law firm.

“You have Sheldon Silver putting the interests of [law firm] Weitz & Luxenberg and the Trial Lawyers Association above that of New Yorkers,” charged Paul Newell, who is challenging him in the Democratic primary.

“Silver is employed by Weitz & Luxenberg for an undisclosed salary for undisclosed work on behalf of undisclosed clients, and if that wasn’t bad enough, he now is personally investing in companies that have business before the state.”

Silver has lent at least $50,000 to Counsel Financial Services, an Upstate company that finances small law firms specializing in personal-injury cases, The New York Times said yesterday.

Silver, who has blocked efforts to cap payouts in such cases, refused to comment.

Monroe Democrats Are So Concerned About Identity Theft They Sent Out A Press Relese To Let The Bad Guys Know What’s Going On

Monroe County Democrats must think every one’s stupid.  They should get out of their offices once in awhile.  If they did, they would know the world is made up of more the the Kool-Aid drinkers that sit around their office everyday kvetching about how awful Republicans are.

Trying to score political points by pointing out to the world that they found several hundred documents (out of 15 million pages) with social security numbers on them is a new low.  The Democrat and Chronicle actually did a decent job covering this story:

County Democratic Party spokesman Sean Hart said party officials heard about the discovery from a constituent.

Yea, right.  The first thing I do when I have a concern about a governmental issue is call Democrat Headquarters.

Sean Hart was so concerned about this breach of security that he:

…orchestrated a news conference outside the clerk’s office for Tom Hasman, the Democratic challenger, who accused his opponent of ignoring “a major security breach” and called on her to take down the Web site until the offending pages could be located and scrubbed.

“This disaster happened because we have a politician, not a professional, in the county clerk’s office,” said Hasman, a computer security consultant.

Asked whether he had notified Dinolfo of the vulnerable Social Security numbers before staging his news conference, Hasman said he had not and that he had only heard about the issue from a campaign worker who had seen the television news broadcast.

“I just found out about this two hours ago,” Hasman said. “I’ve never talked to [Dinolfo] before. I don’t have her contact information.”

Oh, ok, this security professional (Tom Hasbeen) has never heard of a phone book to look up the Clerk’s office phone number.  Or, his buddy Sean couldn’t look it up for him.

And what was the reaction to this news by one of the people who had their security violated?

Arnold Petralia, a Greece lawyer whose Social Security number was visible in a court document online, said he would not lose sleep over the matter.

“I suppose they should be redacted and I’m sure if someone raises a fuss there will be something done,” Petralia said. “But I don’t see the point in worrying about it.”

Mr. Petralia should be worried now.  Thanks to the Democrats efforts to jump start the campaign of a guy who’s name id is probably in the low single digits (maybe not even a whole number) every bad guy who reads the paper knows how to get his information.

And Bob Freeman, the Freedom of Information expert that usually dumps on every elected official, what did he have to say about all of this?

The state’s leading authority on public records, Robert Freeman, of the state Committee on Open Government, said the county clerk’s office is not obligated to redact Social Security numbers from public documents.

Indeed, unredacted copies of original documents containing Social Security numbers on file at the clerk’s office are available to the public upon request.

Oh, geesh, I guess this whole thing was BS.  We at monroerising.com have given Joe The Cat Whisperer Morelle grudging respect for his efforts at turning around the local Democrat Party.  But this effort was more reminiscent of something from the Bob Cook/Ted O’Brien Era.

PAETEC Stock Drops 46% in One Day — Bob Duffy Isn’t Worried

You really have to hand it to Mayor Blue Sky and Sunshine.  Did you see the story on Rnews yesterday stating that PAETEC stock dropped 46% on Friday? Mayor Duffy had this to say:

Mayor Bob Duffy says he’s confident last week’s revenue reports will have no bearing on Midtown.

Worst case scenario? The mayor says there is a plan.

“If something happened to PAETEC we’ll have to go back to Plan B. I don’t want to say what it is, but I will say this, whatever happens we’ll be ready to pick up and go,” Duffy said.

Let me see if I understand this.  The company you are counting on to rebuild on the Midtown site loses almost half of its’ value in one day and you aren’t concerned.

Granted, Blue Sky and Sunshine has led a charmed life.  Who else do you know who could be a registered Republican most of his life, live in Fairport so his kids wouldn’t have to go to City Schools,  move back to the city, switch his registration to Democrat, never be involved in the political process until he decides he wants the top job in the city, claim Bill Johnson is his political mentor, and actually get elected mayor?

We will be watching this with great interest.  For the sake of our community, let’s hope we don’t have to find out what plan B is.

Obama The Politician Flip Flops On Offshore Drilling!

Barack Obama announced a flip flop on a major issue.  He now supports offshore drilling for oil. According to the Olympian newspaper:

The change is dramatic because Obama often pointed to his opposition to drilling as a key difference between himself and presumptive Republican presidential nominee Sen. John McCain.

“I will keep the moratorium in place and prevent oil companies from drilling off Florida’s coasts,” Obama said in Florida in June.

Friday, he said he was still not a fan of drilling, telling the Palm Beach paper, “I think it’s important for the American people to understand we’re not going to drill our way out of this problem.”

Obama also said, in a separate statement issued by his campaign, that he supported the bipartisan energy plan offered by 10 senators Friday.

“Like all compromises, it also includes steps that I haven’t always supported,” he said. “I remain skeptical that new offshore drilling will bring down gas prices in the short-term or significantly reduce our oil dependence in the long-term, though I do welcome the establishment of a process that will allow us to make future drilling decisions based on science and fact.”

(snip)

McCain reacted quickly to Obama’s switch in positions, telling The Associated Press, “We need oil drilling and we need it now offshore. He has consistently opposed it. He has opposed nuclear power. He has opposed reprocessing. He has opposed storage.”

Geesh, I wonder if polls showing 75% of Americans supporting offshore drilling had anything to to with his switch.  Can support for drilling in Anwr be far behind?

Another Person With Questions On War Kids Relief

We first raised questions several months ago about Jon Powers’ charity War Kids Relief.   Take a look at that post if you missed if the first time around.  Our questions focused on the fact that all we could find out about was from the Powers’ PR machine.  All of the website linking to it didn’t work.  We suspected that this organization was little more than a resume builder from a congressional wannabe.

Now others are asking questions.  Here is an e-mail we received from reader goodhuntingwill on this subject.

So Jon Powers started running for Congress sometime in 2007. According to the Buffalo News, the first mention of him as a candidate is March 30, 2007 “Iraq War veteran eyes race against Reynolds”.

In this article by Jerry Zremski, Powers is described as “A 28- year-old Iraq War veteran who later started a charity to help that nation’s children …” (*The Buffalo News*, 03/30/2007, Iraq War veteran eyes race against
Reynolds).

So that is March, Powers officially announces in July. This time in *The Buffalo News*, Bob McCarthy writes, “He founded War Kids Relief, a nonprofit organization aimed at providing Iraqi children with the resources and education to keep them out of terrorism.” (*The Buffalo News*, 07/01/2008, Powers gets a early start)

So two articles in *The Buffalo News* mentions that Powers started a charity to help kids in Iraq. I certainly took notice of this young man who certainly seemed to be about something larger than himself.

However, in an article in the *Niagara Gazette* on July 17, 2007, Powers says to Jill Terreri (and this is Powers’ words, no the reporters) “War Kids has struggled to do much in Iraq on the ground itself…” <http://www.niagaragazette.com/archivesearch/local_story_196174005.html>(*Niagara Gazette*, 07/15/2007, Veteran talks about Iraq and running forCongress)

(Note: Powers first connection to helping Iraqi kids was noted in *The Buffalo News* previously in 2005 for similarly named group called “Orphans and Street Kids Project”. Does anyone know if this is the same group as War Kids Relief?)
So I guess the question this raises is that clearly Powers has used his experience running War Kids Relief as an important start to his candidacy. But in his own words he admitted that War Kids Relief didn’t accomplish much on the ground in Iraq. So what did it accomplish? I would think he would want to discuss and get all of his good accomplishments out there of War Kids Relief.
My e-mail is there: goodhuntingwill@gmail.com. I am certainly willing to listen to any and all sides on this. I just am looking for some answers.

We hope you get some answers goodhuntingwill.  If you do, please share them with us.

Independence Party Considered Contacting The District Attorney About Colon’s Payment

I wonder if anyone at the Democrat and Chronicle is embarrassed?  They should be.  Here is a link to the story they had about the resignation of Independence Party Chairman Rafael Colon.  The Buffalo News had a much better story on the subject.  Here’s some of it:

The chairman of the Monroe County Independence Party has resigned after his wife accepted $5,000 in what party officials call “bribe money” from the campaign of Democratic congressional candidate Jack Davis.

Rafael Colon, a Rochester resident who works in a Batavia factory, quit his local and state positions after Monroe County Independence Party officials confronted him over the payment, according to Walter Schiemann, interim chairman.

“It’s all about what we call the bribe money from Jack Davis,” Schiemann said. “I’m not going to let this party fall into hands like that.”

(snip)

“It’s too much of a mess out there,“ Orsini said last month, referring to the three-way Democratic race. “We don’t know who is going to win the Democratic primary.”

Schiemann, however, said Monday that he has no intention of collaborating with Orsini to replace Fumerelle. That could allow Fumerelle to draw votes away from the Democratic or Republican candidates and diminish the importance the third line on the ballot was expected to hold in this year’s congressional election. An Interesting Website!

I looked at the Drudge Report this morning and saw an ad for “The Real Jon Powers.”  I took a look and it went to this website.

It looks just like Powers’ official campaign website except it points out a number of issues on which Powers has flip flopped.  If you look closely at the fine print, the site is paid for by Jack Davis’ campaign.

One thing caught me eye: they promise an upcoming piece on “The Real Story on War Kids Relief.”  We’ll keep you posted on this.

New York Times Calls For David Gantt’s Removal As Chair Of Assembly Transportation Committee

Does it get any worse than this for a liberal Democrat — the New York Times — the bastion of liberalism calling for your removal?  Well, our old friend Assemblyman was the subject of just such an editorial in yesterday’s paper.

Here’s part of that editorial:

Mr. Gantt is a Democratic assemblyman from Rochester. That’s the Rochester that is 333 miles from Times Square. He has long controlled the State Assembly’s Transportation Committee with an iron fist, micromanaging New York City’s traffic from afar and for bewildering reasons. At one point this year, when journalists asked him why he was blocking a particular city traffic bill, he said: “That’s for me to know and you to find out.” So much for transparency in Albany.

(snip)

It makes no sense for one upstate legislator to strangle progress — and safety — in New York City. This should be a matter decided by New York’s mayor and City Council. Since it is not, Assembly Speaker Sheldon Silver and his Democratic majority should replace committee chairmen like Mr. Gantt who have clearly been there too long. If he won’t, the voters should.

The Times actually take it easy on Gantt.  They fail to mention their previous piece on lobbyist Robert Gaddy’s role in Gantt’s apparent partial change of heart. Here’s another piece they had on the subject.

We’ve written before about the outrageous lack of coverage on this subject by the Democrat and Chronicle. Also their lack of outrage over Gantt’s comments about shooting some damn body.  Take a look at the Youtube piece here.

Maybe I’m all wrong, but I believe Gantt is the only local politician who could get away with this and not be taken to task by Jim Lawrence and the crew at the Democrat and Chronicle.  Clearly, they are holding Gantt to a different standard than everyone else.  I an idea as to why this is the case but I better keep it to myself.

Check Out The LoveFest — Robach Subs For Lonsberry And Governor Patterson Is First Guest

I’m in shock.  I don’t usually admit this, but I am a regular listener to Lonsberry.  I was shocked when I turned it on and heard Joe Robach filling in for Bob and his first guest was Governor Patterson.  They both spoke about the property tax cap — with a circuit breaker “only for those with a very low income.”

I could just feel the love.  Anyone need more proof where Patterson’s heart is.  Despite RICHard Dollinger’s propaganda, it really appears the Governor wants to keep the Senate in sane hands after this year’s election.

Jack Davis 5 Jon Powers 0

We reported earlier  that Jack Davis sent 3 mailings to Democrats in the 26th CD before Memorial Day (you remember Memorial Day — it’s that special day where Jon Powers and his band of zealots were handing out Buffalo Bills schedules) and how Davis was up on TV, well Erie Dem sent us an e-mail claiming that Davis has sent another two mailings.

That brings the total up to 5 mailings.  Erie Dem claims to be a prime Democrat and also claims to have not received one piece of mail from Jon Jon.  If this is true, it makes one wonder what is happen with that “grass roots” support Powers has.

All the glowing posts and hero worship from crazy liberal blogs might make the Powers Platoon feel good, but at the end of the day my money is on mail, television and good pr.
