At the request of prosecutors, a judge today dismissed a felony criminal charge against Andrew Moore, a suspended Republican Party executive director who also serves on the Penfield Town Board.

County Court Judge Richard Keenan agreed to dismiss a felony count of second-degree rewarding official misconduct against Andrew Moore after prosecutors said they had determined that the evidence presented to the grand jury might not be sufficient to justify the charge.

Moore was indicted by a grand jury in early September, and, from the outset, the substance of the felony charge appeared in question. The felony count of rewarding official misconduct is an uncommon charge in New York; in fact, there have only been 25 arrests on the charge since Jan. 1, 2007, according to the Division of Criminal Justice Services.

The move came as a surprise in a politically sensitive case that has reached into the Republican administration of County Executive Maggie Brooks.

After court, District Attorney Michael Green, a Democrat, said he and assistants reviewed the grand jury minutes thoroughly last week and determined the evidence was lacking for the felony charge. He said the question of whether there was an actual reward from Moore was part of the reason prosecutors decided to ask for the dismissal.

I think Mike Green went a little too far — he can forget about that federal judgeship.  This is too much, even for Democrats!
